The need to diversify and strengthen the supply of infant formula in the US is more important than ever. The recent closure of a large infant formula factory, coupled with unforeseen natural weather events, has shown just how vulnerable the supply chain has become.

Infant formula is a staple food product that is the only food source for many children in the United States. Companies and their manufacturing facilities must meet stringent FDA standards that ensure the formula is both safe and nutritious. These standards are essential to protect our children and will not be sacrificed for long term supply issues.

In May 2022, the FDA issued guidelines announcing the agency’s intention to temporarily exercise its freedom of enforcement, on a case-by-case basis, in relation to certain requirements that apply to infant formulas to address a temporary shortage. The Agency has given priority to reviewing applications from companies that can: 1) create documentation to demonstrate the safety and nutritional adequacy of the product; 2) make the largest amount of the product available; and / or 3) rapidly to commercialize the product in the US. The FDA intends to pursue enforcement recognition applications pending the resolution of a temporary shortfall.

The flexibility of the FDA has enabled the agency to help dramatically expand the supply of infant nutrition to address the deficiency while protecting the health of infants, many of whom rely solely on infant nutrition during a critical period of growth and development. To date, this has resulted in a total estimated of over 400 million 8-oz. Baby bottles in the US from nine countries. The freedom of enforcement described in the May guidelines is expected to run until November 14, 2022.

Many companies supplying products with such formulas expressed their interest in continuing the constant service of the American market. For some companies, the agency’s flexibility has resulted in their ability to use a greater extent of their existing global production footprint, making the US infant nutrition supply chain more resilient and reducing the risk of relying on too few manufacturing facilities to support the United States.

This flexibility has proven to be effective in helping to temporarily bring safe and nutritionally appropriate infant formulas to the US market to address a shortage of milk in the formula. Given this success, the FDA has determined that a more simplified path that uses the information we have received for products where we temporarily use enforcement discretion would help ensure the long-term availability and marketing of many of them. As a result, the FDA intends to:

The FDA expects our sustained efforts to help newcomers to the US market for infant formula manufacturers better understand their ability to continue producing and shipping formula to the US in the weeks, months, and years to come.
