Proponents of legalizing online sports gambling are confident they have the votes to pass legislation in this session, just months after failing in a single vote on the House floor.

However, a coalition of North Carolina professional sports teams — big supporters of legalization — is seeking changes that would improve their bottom line but could fragment the advocacy group that has supported the legislation for nearly three years.

The teams want to be assigned eight out of twelve operator licenses available in the state. Last year’s failed legislation outlined an application process for mobile gambling operators to obtain 10 to 12 licenses.

“It gives us a better opportunity to maximize revenue,” Carolina Hurricanes team president Don Waddell told WRAL. “We cannot make money from gambling. We’ll get money through sponsorships and if we do a restaurant or something. So this gives us a better opportunity to capitalize on the amount of money these people are going to make.”

Under their plan, the Carolina Hurricanes (NHL), Carolina Panthers (NFL), Charlotte Hornets (NBA), Charlotte FC (MLS), NC Courage (NWSL), Charlotte Motor Speedway, PGA Tour and NASCAR would each be licensed with one mobile operators to work together. The teams would pay the same fee for the licenses — $1 million in final legislation that failed in the House of Representatives — but they would control them, creating leverage for a more lucrative deal.

“All the teams agree with that,” Waddell said.

Gambling operators would prefer more licenses to be available through the competitive application process. The online sports betting market is dominated by several brands. FanDuel, DraftKings, BetMGM, and Caesars account for nearly 90% of the market share in legalized states, with FanDuel itself holding about half of that.

With fewer licenses available during the application process, smaller teams could be left out or have no choice but to work with a team, and any disagreements between supporters such as operators and teams could make the proposed legislation more difficult to pass.

Many states that have legalized sports gambling have licensed or “tied” to national professional teams, racetracks, or existing casinos.

“That sounds good, because of course that benefits hometown people,” said Rep. Robert Reives, a Chatham County Democrat who voted against the bill last year. “But again, I would hesitate just because I really need to see language. One thing I learned up here is that a lot of things sound great until someone writes them down.”

Legislature begins

State legislatures, who opened new session Wednesday, will return to Raleigh on Jan. 25 for legislative matters. The 120-seat House of Representatives, where a contentious debate in June ended in defeat by one vote for legalization, has 28 new MPs, including 25 first-time MPs. Under legislation proposed last year, sports gambling could bring the state $50 million in tax revenue each year. The state budget is over $25 billion. Rep. Jason Saine, a Lincolnton Republican and top budget author, said the state is looking to cut revenue in states like Virginia and Tennessee because bettors can easily cross state lines to place a bet.

“I believe sports betting will pass in this session,” said Saine, who was the face of the proposed legislation in the House of Representatives.

But even last year, Saine and other supporters were confident.

Senate Bill 688, the Sports Betting Act, passed the Senate in August 2021. But it wasn’t until June that the law began to make its way through House committees. In a chaotic mess, lawmakers proposed a so-called “trailer” bill, Senate Bill 38, to amend the original bill, which increased the fees and taxes paid by operators and changed where tax revenues went. Other changes were made at the house level, including removing college sports betting from the bill.

Opponents of both parties raised moral objections to the state’s expansion of betting, and in some cases recalled the state’s controversial votes to allow the lottery. Others cited previous cheating scandals in sports in their debates. The various changes, as well as the two-bill format, left some confused as to what exactly was happening.

“When we went into this vote, a lot of us didn’t know what we were voting on, who we were benefiting from,” said Reives, who is also the Democrat leader in the House of Representatives. “And when you’re voting on something as serious as gambling, my position is that somehow I have to know what the state of the country is.”

Senate Bill 38 passed with a single vote in the House of Representatives. The original bill, on which all legislation was based, fell by a single vote in the House of Representatives, which had a number of absences and members chose not to vote on the legislation.

Rep. Pricey Harrison, a Guilford Democrat who helped thwart the bill last year, wants expanded consumer protections and more oversight and protection for citizens. “It would be great if there was a way to come up with a bill that people could live with,” said Harrison, who said she can support in-person betting at sports venues. “It may just be that there are too many obstacles to reach an agreement. A new effort

Rep. Zack Hawkins, a Durham Democrat and a sponsor of the legislation, missed much of the brief session due to a family matter. His voice would probably have made the difference. Tennessee is the only state where all licenses are fully tied to racetracks, tribes, retail casinos, or increasingly, sports teams. Arizona’s sports betting bill allowed 20 event betting licenses, 10 of which were reserved for in-state tribes and 10 for owners of Arizona pro sports teams, NASCAR and the PGA Tour.

Massachusetts issued four affiliated licenses to physical casinos and can issue up to seven unaffiliated licenses in the state.

Ohio introduced mobile betting on January 1st. State law allows Ohio casinos, racetracks and professional sports franchises to apply for licenses from NASCAR and the PGA Tour to operate sports betting at their venues. Many franchises in Ohio have already signed partnerships with gaming operators.

North Carolina’s teams want a similar lineup. Legislators have not yet determined a way forward. Hawkins said he was sure the teams, operators and lawmakers could find common ground.

“I just reassured everyone that everyone will be part of the conversation,” Saine said. “No one has a way of getting everything they want, I’m sure. We want to be responsive and listen to all stakeholders.”

He added, “I’m not declaring anyone a winner today.”

In early October, the Hurricanes, Panthers, Hornets, Charlotte Motor Speedway, PGA Tour, Charlotte Football Club and NASCAR hosted a luncheon for state legislators at Raleigh’s PNC Arena. No sports betting companies were among the sponsors of the event, billed as an “economic summit to discuss proposed development projects, sports betting and the economic impact on North Carolina.”
