COLUMBUS, Ohio — Gov. Mike DeWine said he has a personal interest in enforcing state rules on advertising by gambling companies, in his first comments on the subject since the state’s launch of legal sports betting on Sunday.

DeWine told reporters Tuesday that he has shared his concerns directly with the executive director of the Ohio Casino Control Commission, the government agency that regulates betting in Ohio, as well as several members of the casino control commission’s board.

“The companies that advertise en masse should be aware that they are being closely watched by the Governor and the Casino Control Commission regarding any statements they make,” said DeWine. “We think they have crossed the line at least several times. My message to them is that this will not be tolerated in the state of Ohio.”

DeWine declined to elaborate on what he meant by “multiple occasions.”

But he pointed to the $350,000 fine the casino control commission wants to impose on one company for illegally sending advertisements to underage customers. State regulators said Friday that the company, DraftKings, has mailed about 2,500 ads to people under the age of 21, a group that is not allowed to legally gamble in Ohio.

DraftKings is not the first company to be notified. Barstool Sportsbook was issued a notice of violation for an event on the University of Toledo campus earlier in December. Advertising on or near college campuses is also against the rules.

DeWine also drew attention to the promotions that gambling companies offer, such as providing free bet credits, as part of the competition to attract customers to the new gambling market.

“That’s a pretty clear line they can’t cross,” DeWine said. “I also think they should be very careful, frankly, with the claim of ‘free money and free play’. If you look at the fine print, or try to figure out what it really means, it doesn’t mean what is certainly suggested by the TV commercial.”

DeWine, a Republican, signed into law the bill legalizing sports gambling in Ohio in December 2021. But sports betting didn’t become legal until Sunday, under the January 1, 2023 deadline set by state lawmakers. The state has spent the past year building the program, including developing regulations and licensing operators for mobile and personal sports betting.
