San Diego City Council on Tuesday approved a negotiating deal with developers who plan to redevelop approximately 50 acres in the Midway neighborhood, including the Sports Arena area.
By entering into an exclusive negotiation agreement with developers for the Midway Rising project, the city has two years – with the option of adding an additional year if necessary – to conduct due diligence and negotiate with Zephyr Partners, Chelsea Investment Corp. and Legends World.
As councilman Joe LaCava reminded the public at Tuesday’s meeting, the council has not voted on the property deal, and no taxpayer dollars are being spent – at least not yet – saying it is just another step in a long process before breaking through to any redevelopment project.
Midway Rising proposes 4,250 new homes – 2,000 inexpensive, 250 mid-income and 2,000 at market rate; 450,000 square feet arena that seats 14,500-16,500 people; A 200-room hotel and 250,000 square feet of retail space and over 11 acres of parkland and open space along with a 9.4 acres public square.
“I’m delighted to announce that I recommend an exclusive negotiating deal with Midway Rising to redevelop the Sports Arena,” Mayor Todd Gloria said last week. “After going through a transparent and state-compliant process, I am confident Midway Rising will fulfill my vision of creating thousands of new affordable middle-income homes, well-paying jobs, and a new world-class arena and entertainment district.
“This project represents the energy of the big city and I can’t wait to do it for the Midway community and our city,” said Gloria.
Chelsea are in charge of the low-cost condo in the project, while Legends is in charge of the arena. Zephyr will build apartments with market value if negotiations come to this point.
The City Council’s Land Use and Housing Committee approved the Midway Rising project last week from a list of three candidates for a 48.5-acre redevelopment in the Midway-Pacific Highway Community.
Councilor Raul Campillo expressed concern about the feasibility of the project, the lack of childcare-focused companies proposed in the retail section of the project, and the “ballpark” figures.
“I want affordable housing and I want affordable housing as soon as possible, but I want to vote for something I can believe in,” he said. “For this reason, I cannot support the recommendation of the city staff today.”
He was the only one who did not vote, and Councilor Vivian Moreno was absent.
It was reported ahead of Tuesday’s vote that developer Brad Termini, founder and owner of Zephyr, donated $ 100,000 to an independent commission supporting Mayor’s Gloria 2020 campaign and failed to disclose 10 lawsuits where his company was involved in unrelated development projects.
An article published last week in La Prensa highlighted concerns that have led some government watchdogs to cry.
“Something is wrong and it is time for San Diego City Council to ask the tough questions before millions of public dollars are wasted,” wrote leaders of Alliance San Diego, Partnership for the Advancement of New Americans, Think Dignity, San Diego Housing. Emergency Alliance and others in a joint statement. “There are indications of a lack of significant due diligence that could jeopardize the future of this project and the benefits to our communities, including the profitable development of badly needed housing, including affordable housing.”
San Diego’s interim COO, Jay Goldstone, conveyed a lot of concern to other developers trying to gain an edge in project selection. He said city staff had exercised due diligence in investigating past lawsuits. Assistant City Attorney Leslie Fitzgerald echoed Goldstone’s remarks, saying the City Attorney’s Office had found nothing deserving extra caution in a previous Monterey dispute.
The choice of an arena developer, however, will be moot if San Diego voters fail to pass Measure C this November, which would raise the 30-foot building height limit in the Midway neighborhood. This is the second attempt to increase the growth cap in the area after a judge ruled the first 2020 voting measure illegal.
Last September, City Council unanimously voted to declare the Sports Arena site as surplus land as defined by the California Department of Housing and Community Development. The declaration also includes the condition that “future development includes the renovation or replacement of the city’s current sports hall with real estate as a regional entertainment venue and the operation of this venue for concerts, sporting and other events consistent with similar arenas in major US cities.”
This May, the council shortened the list of five to the current one of three, which includes Gloria’s favorite Midway Rising, as well as Midway Village + and Hometown SD.
Developers had to mark 25% of the proposed housing as affordable and preferred developers with the most affordable housing offered and the highest affordability levels.
The redevelopment of the Sports Arena site is part of the Midway-Pacific Highway community plan update, which began in 2010 and serves as a blueprint for the neighborhood’s future development. The plan provides for the Sports Arena Community Village, which will include a mix of entertainment, office, retail, housing, utilities and parks.
