As the application process began this week for business owners to enter the mobile sports betting industry in Maryland, state lawmakers are accepting public comments on proposed regulations to guide licensing.

The Sports Wagering Application Review Board held a 30-minute public hearing Friday but heard mostly from one person: Arthur Robinson, CEO of Baltimore-based Full Circuit Solutions.

Robinson’s testimony focused on persuading the board to allow the $500,000 application fee for the mobile license to be refunded. The rules now say that and other fees are non-refundable when an organization requests, the provisions of the legislature approved last year.

“The fees should be refunded if the license is not granted. This seems unfair,” Robinson said.

Robinson also said that part of the proposed rules on efforts to interview minority and women-owned investors should be required.

“The language ‘if applicable to efforts’ does not appear to make it a requirement,” he said.

The commission last Friday approved diversification requirements for companies granted mobile licenses, which must submit a plan that includes strategies to achieve diversification. That process, however, is retroactive and can be done within 30 days of license approval.

Meanwhile, applicants have until Oct. 21 to apply for one of the 60 mobile gaming licenses and up to 30 B licenses, which are smaller activities than casino-based sportsbooks. The board began taking applications on Tuesday.

Those approved will go through another round of background checks that can take up to 45 days.

Due to this schedule, it is possible that mobile sports betting could take place by the end of this year’s NFL regular season in December, but that depends on the approval of SWARC and the Lottery and Gaming Commission of Maryland, which oversees the sports betting industry.

Gov. Larry Hogan (R) pushed for mobile wagering to begin before the NFL regular season begins Thursday.

“After overcoming many operational hurdles from the legislative committee, we are finally seeing some progress on mobile betting,” he posted on his Twitter page on Tuesday. “I’m going to continue to hold everyone’s feet to the fire until this is up and running. The people of Maryland have waited long enough.”

Meanwhile, the public comment period on the SWARC rules can still be submitted in writing on September 26.
