A participant in the second season of the Netflix reality series “Love Is Blind” is suing the show’s streamers and producers, accusing them of a series of violations of labor law, including the promotion of “inhuman working conditions” and cast members less than to pay the minimum wage.

The lawsuit, filed by Jeremy Hartwell, alleges that “Love Is Blind” producers beat the cast with alcohol and deprived them of food and water – while paying rates that were below the Los Angeles County minimum wage. The lawsuit, filed in the California Supreme Court in L.A. filed, named as defendant Netflix, production company Kinetic Content and Kinetic Casting company Delirium TV.

Variety has reached out to Netflix and Kinetic content for comment.

Hartwell, who is a director at a mortgage company in Chicago, claims he spent a few days recovering from the effects of sleep deprivation, lack of access to food and water and large quantities of alcohol he was supplied with. “Love Is Blind” Season 2 premiered on Netflix in February 2022.

According to the process, “Love Is Blind” candidates should be classified as employees under California state law rather than independent contractors because the producers dictated the timing, manner, and means of their work. During production, producers paid competitors $ 1,000 a week – even though they were forced to work up to 20 hours a day, seven days a week. That works out to as little as $ 7.14 per hour, well below the Los Angeles County minimum wage of at least $ 15 per hour, according to the complaint.

The producers of the show “carefully underestimated the crew members, deprived them of food, water and sleep, cut them off with alcohol and cut off their access to personal contacts in most of the outside world. This made crew members hungry for social connections and their Emotions and decision-making processes have changed, ”said attorney Chantal Payton of Payton Employment Law, the LA-based firm that represents Hartwell.

Hartwell’s costume seeks class action status on behalf of all participants in “Love Is Blind” and other non-scripted productions created by the defendants over the past four years. Payton Employment Act estimates the potential size of the plaintiff class to number more than 100 individuals.

According to Hartwell’s suit, the show’s contracts required candidates to agree that if they left the show before it was completed, they would have to pay $ 50,000 in “liquidated damages”. The lawsuit alleges that members of the reality show “either have a genuine fear of retaliation and damage their reputation for any resistance to the orders of those who hold the wallet or they are unaware of their rights.”

Payton said in a statement to his lawyers, “Reality show production and casting companies exercise much more control over the candidates than the law allows a worker to be truly regarded as an independent contractor, especially in shows where cast members are allegedly looking for love. . “

Kinetic content, in addition to “Love Is Blind”, also produces reality shows “The Ultimatum: Marry or Move On”, which debuted on Netflix this year, and “Married at First Sight”, which was created in 2014 and will be on Lifetime and Streams on Netflix.

In “Love Is Blind”, the contestants – 15 men and 15 women – meet their dates from separate “pods” and talk through speakers, unable to see each other. Two participants have to commit before they are allowed to meet face-to-face, which for some participants leads all the way to a marriage on screen and for others a wedding breakup. “Love Is Blind” has just recorded a 2022 Primetime Emmy Awards nomination for Structured Reality program (and earned Emmys two names in 2020) and has created Brazilian and Japanese versions.

The 3rd season of “Love Is Blind,” set in Dallas, is set to hit Netflix later this year.

“The combination of sleep deprivation, isolation, lack of food, and an excess of alcohol, all either required, activated, or encouraged by the defendants, contributed to inhumane working conditions and altered mental status for the occupation,” Hartwell read in his complaint. “Sometimes, the defense members left the crew alone for hours at a time without access to a phone, food or any other contact with the outside world until they were asked to return to work on the production.”

Hartwell’s lawsuit seeks unpaid wages plus, financial compensation for missed meal breaks and rest periods, plus unspecified monetary damages for unfair business practices and civil penalties for violating work codes.

The lawsuit was filed on June 29 in the California Supreme Court for Los Angeles County. The case number is 22STCV1223.
